Terms of Service
Article 1 Purpose The purpose of these Terms and Conditions is to stipulate the rights, obligations and responsibilities and other necessary matters between the Company and the Member in relation to the use of the automated trading bot service provided by GeniX (hereinafter referred to as the "Company") and all services incidental thereto (hereinafter referred to as the "Service").
Article 2 Definition of Terms
- "Service" means the cryptocurrency exchange-linked automated trading program, API management tool, analysis system, and related web/mobile functions provided by the Company.
- "Member" means a person who concludes a use contract with the Company and uses the Service in accordance with these Terms.
- "Account" means the unique ID created by the Member to use the Service.
- "API Key" means the unique access information issued by the Exchange to interact with the Service.
- "Exchange" means an external third-party platform for buying and selling cryptocurrency.
Section 3 Effectiveness and Changes to the Terms
- These Terms shall take effect by posting on the Service screen or otherwise notifying you.
- The Company may amend these Terms within the scope of not violating relevant laws and regulations, and will provide prior notice of such amendments.
- If the Member does not agree to the revised Terms, he/she may stop using the Service and withdraw, and if he/she continues to use the Service, he/she shall be deemed to have agreed.
Article 4 Establishment of Use Agreement
- Membership is established when the Member agrees to these Terms and Conditions and the Company approves it.
- The Company may not approve membership in any of the following cases.
- If the information of another person is stolen or falsely stated.
- If a minor applies without the consent of his/her legal representative
- In other cases deemed inappropriate by the Company
Article 5 Provision and Change of Services
- The Company provides automatic trading functions based on exchange API integration to members.
- The Company may change or discontinue all or part of the Service and will notify you in advance.
- The Company shall not be liable for any losses caused by the modification or suspension of the Service.
Article 6 Service Hours
- The Service is provided 24/7, but may be suspended for maintenance and system reasons.
- If possible, the Company will suspend the Service after prior notice.
Article 7 Member's Account and Management Responsibilities
- Members shall manage their accounts and API keys securely and under their own responsibility.
- The Member shall be responsible for any losses caused by account theft, neglect of management, etc.
- The Member may not transfer, rent, or sell the Account to a third party.
Article 8 Member's Obligations
- Members shall comply with these Terms, relevant laws and regulations, and the Service Usage Rules.
- Members shall not engage in any of the following acts
- Steal other people's accounts/information
- System infringement such as hacking, reverse engineering, etc.
- Engage in illegal or unethical behavior
- Spam, cause excessive server load
- Infringement of the rights of the Company or other members
Article 9 Obligations of the Company
- The Company shall do its best to provide stable services.
- The Company shall protect Members' personal information in accordance with relevant laws and regulations.
- The Company shall continuously improve the Service for the convenience of members' use.
Article 10 Service Fee and Payment
- The basic scope and fees of the Service shall be announced separately.
- Payment for paid services is made through the designated payment method.
- In principle, the amount paid is non-refundable; however, if the service is not available due to reasons attributable to the Company, it will be refunded.
Article 11 Investment Liability and Indemnification
- The Company does not guarantee any profit on the results of automated trading.
- The final responsibility for all investment behavior rests with the member.
- The Company is not responsible for losses caused by reasons not attributable to the Company, such as cryptocurrency market fluctuations, exchange policy changes, API errors, network failures, etc.
- The Service is not an investment advisory or financial service.
Article 12 Damages
- If the Member violates the Terms or illegally uses the Service and causes damage to the Company or a third party, the Member shall compensate the Company.
- If the Company intentionally or grossly negligently causes damage to the Member, the Company shall be liable.
- However, the scope of the Company's compensation shall be limited to the amount of the usage fee paid by the Member in the last three months.
- The Company shall not be liable for indirect, special, or unexpected damages.
Article 13 Restriction and Termination of Service Use
- The Company may restrict the use of the Service or terminate the Agreement without prior notice if the Member violates the Terms.
- Members may withdraw at any time, and upon withdrawal, personal information will be processed in accordance with laws and regulations.
- Accounts that are not used for a long period of time may be dormant.
Article 14 Intellectual Property Rights
- Intellectual property rights such as copyright and trademark rights related to the Service belong to the Company.
- Members may not reproduce, distribute, or process them without the prior consent of the Company.
Article 15 Advertising and Marketing
- The Company may place advertisements in the course of operating the Service.
- Members may agree or withdraw their consent to receive advertising information.
Article 16 Force Majeure The Company shall not be liable if the Service cannot be provided due to reasons beyond the Company's control, such as natural disasters, epidemics, wars, government regulations, international conflicts, terrorism, exchange closures, communication failures, etc.
Article 17 Special Rules for Overseas Users
- The Service may be provided to members worldwide, but certain countries and regions may be restricted by laws and regulations.
- Members must comply with the laws and regulations of their country of residence, and assume all responsibility for any violations.
- If the Terms are provided in multiple languages, the Korean version shall prevailin the event of any conflict in interpretation.
Article 18 Notification and Announcement Methods
- The Company may notify Members through notices, emails, in-service notifications, etc.
- Emergency notices shall be effective only by posting in the Service.
Article 19 Governing Law and Jurisdiction
- These Terms shall be governed by the laws of the Republic of Korea.
- In the event of a dispute, the court located at the Company's headquarters shall have primary jurisdiction. However, disputes with overseas members may be resolved through an international arbitration organization if the Company deems it necessary.
